1.1. Identity of the Operator:The Service is published and operated by E-NOVAI GROUP SARL, a limited liability company incorporated under the laws of Morocco, operating under the trade name “WAYLI” (hereinafter the “Operator”).
Transitional Clause:The Operator is in the process of establishing a UAE-registered entity (Freezone or LLC, hereinafter the “UAE Entity”). Upon registration of the UAE Entity, the operation of the Service, including all rights and obligations under these TOU, shall be automatically transferred to the UAE Entity by operation of law, without requiring the User to accept new Terms of Use. Users will be informed of this transfer by a notice published at trywayli.com and, where reasonably practicable, via a WhatsApp message. The applicable TOU version shall be updated to reflect the new operating entity at that time.

In the event of a contradiction, the order of priority is: TOU, then Privacy Policy, then Transparency Charter.
WAYLI is an intelligent conversational platform (chatbot) accessible primarily via WhatsApp, using artificial intelligence technologies to provide users with suggestions and information on places and activities (restaurants, cafes, rooftops, hotels, experiences, etc.).
The Service is provided for informational and discovery purposes only. WAYLI does not constitute under any circumstances:
A guaranteed booking service;
A certified recommendation;
Professional advice (medical, legal, financial, real estate, etc.).
Access to the Service may be offered via WhatsApp and/or via web interfaces or other channels announced by WAYLI. Unless otherwise stated, no complex account is required: the phone number may serve as an identifier on WhatsApp.
You must have a compatible terminal, an internet connection, and, where applicable, a WhatsApp account. The use of WhatsApp is subject to the terms and policies of WhatsApp/Meta, independently of these TOU.
The Service is intended for persons aged at least 18 years.
United Arab Emirates Specificity: You acknowledge that certain recommendations (bars, clubs, venues serving alcohol) are strictly reserved for persons aged 21 years and over, according to local legislation. It is your responsibility to verify your eligibility before visiting an establishment.
By sending a first message to WAYLI, scanning a QR code leading to the Service, or using the Service, you acknowledge having read these TOU and accept them without reservation.
Upon your first interaction, WAYLI will present a summary of these TOU and your data rights in the WhatsApp chat. You may at any time type /stop-ai to withdraw consent to AI training, or /delete to request permanent erasure of your data, as described in the Privacy Policy.
WAYLI may modify the TOU to reflect developments in the Service, regulation, or security. The applicable version is the one published at the time of use. In the event of a substantial modification, WAYLI may inform you by any reasonable means (WhatsApp message, website, etc.).
The Service uses Generative Artificial Intelligence technology. Although high-performing, this technology may produce inaccurate, outdated, or unverified information (commonly referred to as “AI errors”).
In particular, any statement made by the WAYLI chatbot using affirmative language — such as “available”, “open”, “confirmed”, “I checked”, or similar — does not constitute a guarantee, a booking confirmation, or a verified real-time status. Such statements reflect the AI's best available inference from its training data only.
Important Warning — Mandatory Verification Obligation:WAYLI cannot guarantee the real-time accuracy of opening hours, prices, availability, dress codes, or entry policies of establishments. This information changes frequently and without notice. By accepting these TOU (Onboarding Click at first message), you expressly acknowledge that:
(i) you must independently verify all material information directly with the establishment before any travel, payment, or booking;
(ii) WAYLI bears no liability for any disappointment, refusal of entry, financial loss, or prejudice resulting from reliance on unverified information provided by the Service; and
(iii) the chatbot's affirmative statements do not replace direct confirmation from the establishment.
Information concerning establishments and activities may come from public sources, the establishments themselves, the community, or third-party partners.
WAYLI does not guarantee: availability (tables, stocks), accuracy of prices, nor the compliance of an establishment with hygiene or safety standards. We recommend that you verify directly with the establishment.
As part of the continuous improvement of the AI, WAYLI may invite you to share your feelings about an experience (“Feedback”) via the WhatsApp conversation.
8.1. Data Usage:By submitting Feedback, you grant ENOVAI GROUP a worldwide, royalty-free license, for the duration of the Service or until you request deletion of your data, to use, analyze, and synthesize this information to train the algorithm, refine the “Taste Graph”, and improve the relevance of the Service.
8.2. Confidentiality and Publication: At this stage, your Feedback is processed internally to calibrate the AI. However, WAYLI reserves the right, in the future, to publish anonymized or aggregated summaries of these reviews, without revealing your identity. You may object to this use at any time by contacting privacy@trywayli.com.
8.3. Responsibility: Even in a private exchange with the chatbot, you undertake to remain courteous and factual, in accordance with applicable local laws.
9.1. Ranking Methodology:The Service utilizes an algorithmic processing system to select and rank recommended venues. This ranking is primarily established based on objective relevance criteria, including but not limited to: alignment with the User's query (intent, budget), geographical proximity, and aggregated quality indicators (reviews, popularity).
9.2. Management of Commercial Partnerships (Mandatory Relevance Principle):The Operator markets visibility solutions to professionals (“Partners”). However, the existence of a commercial agreement is subject to the following rules:
• Prohibition of Misrepresentation: Partner status shall not compel the algorithm to recommend a venue that is manifestly inadequate in relation to the User's query (e.g., recommending a steakhouse for a strictly vegetarian request).
• Visibility Mechanism: The partnership acts as a positive weighting factor. In cases of substantially equivalent relevance between two venues, the Partner shall benefit from priority exposure.
9.3. Advertising Disclosure:In accordance with applicable regulations in the United Arab Emirates regarding media transparency, any result the display of which is influenced by financial consideration is identified to the User by a distinctive mention (such as “Sponsored,” “Featured,” or a specific visual badge).
9.4. Absence of Conflict of Interest (Business Model):The User is informed that the Operator's remuneration is based on fixed subscriptions paid by professionals. Unless expressly stated otherwise, the Operator receives no commission on final transactions (bookings, bills) made by the User, thereby ensuring the objectivity of the recommendations provided.
It is strictly prohibited to use WAYLI to disseminate hateful, violent, pornographic content, or to harass others.
SPECIFIC WARNING (UAE CYBERCRIME LAW):As a user subject to the laws of the United Arab Emirates, you are informed that Federal Decree-Law No. 34 of 2021 (Cybercrimes) heavily sanctions:
Defamation: Any statement damaging the reputation of a person or a company;
Invasion of Privacy: Sharing photos or videos of third parties taken without their explicit consent.
WAYLI may suspend, restrict, or delete access to the Service, immediately and without notice, notably in the event of a violation of the TOU, abusive behavior, or security risk.
Amicable Remedy: If you believe a measure has been applied in error, you may contest it by contacting support@trywayli.com.
WAYLI is an independent service operated by ENOVAI GROUP. We are neither affiliated with nor sponsored by WhatsApp or Meta. ENOVAI cannot be held liable for outages or policy changes of WhatsApp/Meta.
The Service is provided “as is”. WAYLI does not guarantee continuous access, error-free operation, nor the preservation of conversation history. WAYLI shall not be liable for any failure or delay in the provision of the Service resulting from circumstances beyond its reasonable control, including but not limited to: outages or policy changes of the WhatsApp/Meta platform, server infrastructure failures, acts of God, regulatory actions by UAE or Moroccan authorities, or internet connectivity disruptions (“Force Majeure”). In the event of Force Majeure, WAYLI will make reasonable efforts to restore the Service as soon as possible.
14.1. Voluntary and Occasional Nature:The use of geolocation is strictly optional. It is activated only if you decide, on your own initiative, to share a “Location Pin” via the WhatsApp interface to obtain recommendations around you.
14.2. No Background Tracking:Unlike a traditional mobile app, WAYLI does not have continuous access to your phone's GPS. We cannot track you in real-time. We only receive the static GPS coordinates at the precise moment you send the message. Once the recommendation is provided, we do not track your subsequent movements.
14.3. Data Usage: The coordinates provided are used exclusively to calculate the distance between your location and the recommended venues, in order to sort results by proximity.
The processing of personal data is described in the Privacy Policy available at: trywayli.com/privacy. We do not sell your personal data to establishments. You may exercise your rights (access, deletion, etc.) by contacting us at support@trywayli.com.
The WAYLI brand, interface, chatbot architecture, and algorithms (“Taste Graph”) remain the exclusive property of ENOVAI GROUP. Any unauthorized reproduction is prohibited.
To the fullest extent permitted by applicable law, ENOVAI declines all liability for choices made by the user, incidents occurring in an establishment, or the quality of third-party services.
18.1. Termination by the User: You may cease using the Service at any time, without notice. To request the deletion of your data upon cessation, type /delete in the WhatsApp chat or contact support@trywayli.com. Your personal data will then be processed in accordance with the Privacy Policy and applicable retention periods.
18.2. Termination by WAYLI: WAYLI reserves the right to suspend, restrict, or permanently terminate your access to the Service, with or without prior notice, in the event of: (i) violation of these TOU; (ii) abusive, fraudulent, or illegal use; (iii) security risk to the Service or other users; or (iv) cessation of the Service in whole or in part.
18.3. Effect of Termination: Upon termination, your right to use the Service ceases immediately. Clauses that by their nature should survive termination (including Sections 10, 16, 17, and 19) shall remain in force.
19.1. Governing Law: These TOU are governed by and interpreted in accordance with the Federal Laws of the United Arab Emirates and the laws of the Emirate of Dubai.
19.2. Jurisdiction (B2C): The Operator and the User shall first attempt to resolve any dispute amicably within 30 days of written notice to legal@trywayli.com. Failing amicable resolution, any dispute arising from or in connection with these TOU, the Service, or the User’s data shall be submitted to the exclusive jurisdiction of the DIFC Courts (Dubai International Financial Centre Courts), and specifically to the Small Claims Tribunal (SCT) for claims not exceeding AED 500,000.
The parties expressly agree to opt in to the jurisdiction of the DIFC Courts pursuant to Article 5(A) of the DIFC Court Law (DIFC Law No. 10 of 2004, as amended). Proceedings shall be conducted in English. This election of jurisdiction is made in the interest of accessibility to the User and shall not be construed as the Operator having a physical presence within the DIFC.
Safeguard Clause:Should the DIFC Courts decline jurisdiction on procedural grounds, the dispute shall be brought before the competent courts of Marrakesh (Morocco), applying the substantive consumer protection principles of the UAE as supplementary rules. Upon registration of the UAE Entity referred to in Article 1.1, this clause shall be automatically updated to designate the relevant UAE courts as primary jurisdiction, without requiring the User to accept new Terms of Use.

WAYLI uses controls to detect manipulations. We reserve the right to downgrade the visibility of a suspicious establishment.
